It is a beautiful warm sunny wintry day here in the mountain valley and well accepted after our couple of days of snow this week... Had a great visit with my son, which was a break I needed away from all this mass mess going on with my websites and computer...

As the week begins take stock of your health and the changes that you might need to make to get your body in shape and the immune system working properly. As I receive calls from customers/clients I find that there are a lot of colds going around right now so make sure you tune your immune system up to ward off the cold viruses... Make sure you have plenty of minerals and silver water on hand to take care of one should it get past your immune system...

Today's ezine appears to be political but it's not, I just get so angry when the people who claim to be protecting us put us in harms way and take away our freedoms with their mindless moves! So I'm passing some of those mindless moves on to you...

Lena Asks - The Government circumventing existing legislation?

The supplement act passed a few years ago was a hands off message to the government on controlling supplements, but our government is in the throes of circumventing that law and has their aim on a multitude of other supplements... Just watch, soon you will hear of other supplements that are supposedly dangerous for us... They think we are not capable of making our own decisions in matters of what we put into our body... If they want to protect the people they would take hundreds of prescription and OTC drugs off the market that kills thousands daily while ephedra containing products have not killed anyone who took them sensibly and has helped hundreds of thousands over the years be healthy and stay healthy! Athletes, as a rule, do not do much of anything sensibly, hence the death of one athlete was jumped on by the FDA, with a push from their drug company friends, as a means to circumvent a law that the pharmaceutical industry put billions of dollars into fighting and lost... They are going at it another direction now and winning, but we are losing! Acetaminophen and aspirin products have killed thousands yet is still being sold over the counter and nothing is being done to PROTECT us from those or the drug companies that manufacture them and make billions of dollars? The ban does not effect the ephedrine (ephedra derived pharmaceutical drug) from being manufactured, yet the products that contain it does and has killed far more and made thousands ill from their usage, but then it makes billions of dollars for the drug companies and funds a large number of our elected politicians campaigns... Hence I scratch your back and you scratch mine by making me a lot more money so I can elect more!!! It is sad when people no longer are important but money runs everything!!!

Sales of Ephedra to Stop by April

WASHINGTON (AP) -- Sales of ephedra must stop by early April, the Food and Drug Administration said Friday in finalizing its ban of the herbal stimulant.

In the meantime, "do not take these products. They are simply too risky," warned FDA Commissioner Mark McClellan.

Ephedra has been linked to 155 deaths and dozens of heart attacks and strokes.

The FDA first announced in December that the ban was coming, but on Friday issued a regulation formally setting it in motion. The law requires a phase-in period, and the FDA says sale of ephedra will become illegal on April 12.

It is the government's first-ever ban of a dietary supplement.

Ephedra once was hugely popular for weight loss and body building. But it can cause life-threatening side effects even in seemingly healthy people who take the recommended doses, because it speeds heart rate and constricts blood vessels. It is particularly risky for anyone with heart disease or high blood pressure or people engaging in strenuous exercise.

Critics say the ban was too long in coming. Sales already have plummeted because of publicity about the risks, which peaked after the ephedra-related death of Baltimore Orioles pitcher Steve Bechler a year ago. Three states - New York, Illinois and California - have passed their own bans.

The FDA says it couldn't have acted faster because, unlike with pharmaceuticals, federal law allows dietary supplements to sell without first providing proof of safety. That law requires the FDA to prove a clear danger to public health to curb sales. Manufacturers blocked a 1997 FDA attempt to restrict sales of certain dosages and put warning on the herb by arguing the agency lacked enough proof that it harmed.

The delay marks a "shameful track record" that "points to the need for fundamental reform," said Bruce Silverglade of the Center for Science in the Public Interest, a consumer advocacy group. He called on Congress to change the law so the FDA could more easily protect consumers.

Ephedra divided the dietary supplement industry. Some manufacturers welcomed the upcoming ban as a way to lift a cloud of controversy over their industry.

Even though the market leader, Metabolife International, suspended ephedra sales last year, it continues to defend the herb. But Metabolife isn't saying whether it will sue to try to block the ban.

"Metabolife believes their products are safe and effective when used as directed," said spokeswoman Jan Strode. "We are currently reviewing the rule and are assessing our options."

The FDA cautions that it is monitoring the new ingredients that are replacing ephedra in supplements touted for energy and weight loss. Top of that list is bitter orange, an ephedra mimic that some studies show can interact dangerously with certain medications.

In a study reported in the Journal of the American Medical Association, people who ate a high-fiber diet over a 10-year period gained the least weight, regardless of how much fat they consumed. By slowing the absorption of nutrients into the bloodstream, fiber helps curb insulin production after a meal. The higher insulin levels associated with low-fiber diets seem to help promote weight gain by stimulating fat storage and increasing appetite.

The National Cancer Institute recommends eating 20 to 35 grams of fiber a day. Most Americans get roughly 15 grams. By contrast, studies conducted in rural Africa, where obesity is rare, found that Africans consume about 80 grams of fiber daily. Boosting your intake by even a few grams a day may make a difference: An British study found that lean adults averaged 19 grams of fiber daily, while obese adults averaged only 13.

Another benefit of fiber is that it may help you feel fuller longer. To test this hypothesis, researchers fed overweight subjects 350 calories of oatmeal or cornflakes, then three hours later allowed them to drink as much as they wanted of a nutritional shake. The people who ate the oatmeal, which is higher in fiber, sipped 40 percent less than the cornflake eaters.

So stock up on high-fiber foods, and try to turn your thinking upside down: Make fresh and cooked vegetables and fruits, as well as whole grains and beans, the stars of your meals. Relegate meat and poultry to a supporting role as often as possible.

BUSH SPEECH IN ARKANSAS ON MEDICAL MALPRACTICE

Today, President Bush is holding a roundtable discussion at Baptist Health Medical Center in Little Rock, Arkansas, with "area medical leaders," to call for limiting the legal rights of patients injured by medical malpractice, saying such laws will lower health care costs. This is a blatant misrepresentation of facts.

This month, the Congressional Budget Office found that "malpractice costs account for less than 2 percent of [health care] spending." Moreover, CBO found that caps would make essentially no difference in health care costs or health insurance premiums; a bill with caps on non-economic damages and a ban on punitive damages, such as advocated by Bush, "would lower health care costs by only 0.4 percent to 0.5 percent, and the likely effect on health insurance premiums would be comparably small." (emphasis added) Congressional Budget Office, Limiting Tort Liability for Medical Malpractice (Jan. 8, 2004). 

Far from addressing so-called "frivolous lawsuits," the President's plan would broadly restrict the constitutional rights of all American citizens to go to court while weakening the system's ability to prevent medical errors. It will do nothing to help doctors who are being price gouged by insurance companies. Moreover, it will is proportionately hurt the most severely injured Americans, such as seniors in nursing homes, quadriplegic workers and brain-damaged children.

In September 2003, Southwest Region Medical Center in Little Rock stopped delivering babies for reasons having nothing to do with liability costs. The hospital averaged only 12 deliveries per month. Charles Smith, medical director of UAMS Medical Center said that women
prefer larger hospitals with the large staff, technology, and equipment to deal with complications.

Baptist Health paid its president over $570,000 in salary and benefits in 2001 - more than double the lifetime limit on non-economic damages George W. Bush wants to impose on all victims of medical malpractice. Several other administrators and physicians were also paid over $250,000 in 2001 - more than the lifetime cap proposed for malpractice victims. These figures may underestimate their income, as they reflect only salary and benefits paid to them by Baptist Health, not income from private practice or other income-producing activities.
