FDA Warns Makers of Levitra, Zyrtec on Ads

WASHINGTON (AP) - Federal regulators have told the makers of the popular drugs Levitra and Zyrtec to pull some advertisements the regulators said made unsubstantiated claims.

The Food and Drug Administration said Friday it sent letters this week notifying Bayer Pharmaceuticals Corp. and Pfizer Inc. (PFE) that a television commercial for Levitra and three direct-mail advertisements for Zyrtec made unsubstantiated claims of superiority over competing products.

In Levitra's case, Bayer also failed to disclose FDA warnings and product information, the letter said. It was the fourth such warning for Pfizer about Zyrtec.

The commercial for Levitra, an erectile dysfunction drug, features a woman praising the drug, and, according to the FDA, implying that her sexual experience with her partner was satisfying as a result of her partner's use of Levitra. She says the drug is "the best way to experience the difference." The FDA said this is an unprovable claim.

The commercial also fails to highlight side effects and FDA warnings, the agency said.

Matthew Scampoli, a spokesman for Schering Corp., which markets Levitra for Bayer, said the 15-second commercial is one in a three-commercial campaign. He said the remaining commercials would remain on the air but said, "We are going to comply with the FDA's request," to pull the 15-second spot.

"We're currently reviewing all our Levitra promotional material to address the issues raised by the agency," he added.

The ads for Zyrtec compare two people; one obviously sick, sneezing or wiping her nose, and another who looks perfectly healthy. The captions of the ads imply that the healthy and alert-looking person has taken Zyrtec; the sickly and unhappy one has taken a different medication.

The FDA said it "is not aware of substantial evidence or substantial clinical experience demonstrating that Zyrtec is clinically superior" to any other available over-the-counter or prescription allergy medicine.

An attempt to reach Pfizer by telephone after business hours on Friday was unsuccessful.

The FDA requested that both companies cease the ad campaigns and respond in writing to the request. It also said that since this was the fourth warning about the same problem for Pfizer, that Pfizer include in its response an outline of how it plans to make "truthful, non-misleading and complete" corrections to its ads.

LENA'S COMMENT: This looks like a good thing, right? The FDA wants you to think so and wants think they are doing their job. Well, the sad truth is that the months and years it takes for a company to be reprimanded by the FDA that particular advertising has run it's course and the drug company is on to another one so all they have to do is send a report stating that it has been withdrawn. The new ad will be just as misleading but the merry-go-round of reprimands and warnings start all over again... This type of smoke screen has been going on for years and will continue...

Phaseolus vulgaris,

Legumes of all kinds are great foods and should be eaten at least twice a week for greater health. Black beans, botanically-known as Phaseolus vulgaris, are native to the Americas. One of over 500 varieties of kidney beans, black beans are also known as turtle beans, caviar criollo, black Spanish beans, Tampico beans, Venezuelan beans and frijoles negros. These beans date back at least 7,000 years when they were a staple food in the diets of Central and South Americans.

Black beans are about the size of a pea, up to 1/2-inch long, with the slightly less-pronounced boat-shape common to kidney beans.

The darker the bean the more the antioxidant content. Out of all the bean family black beans win with the most nutrients.

Black beans are an amazing food! One-half cup of cooked black beans has as many antioxidants as two glasses of red wine. Not only that but they are packed with fiber and folate, which are touted to be great at reducing the risk of heart disease. Black beans, as all dried beans, are also good sources of starches, fiber, B vitamins, iron, zinc, phosphorus, complex carbohydrates and calcium. About half of the calcium is lost during cooking. High percentages of the other nutrients remain however, even after cooking.

All legumes are high in protein, and black beans are no exception. Dried beans are important sources of protein in vegetarian diets, and in areas where animal protein is scarce or expensive. However, this protein is incomplete (does not contain all 9 amino acids), so grains (which provide the missing amino acids) must also be a significant part of the strictly vegetarian diet. In the areas where common beans originated (Central America and southern Mexico) corn and squash supplied the missing amino acids and additional source of vitamins.

Before cooking, be sure to pick through them, picking out any small pebbles, split and withered beans and any other foreign matter. (Beans from the Rockies and Pacific coast tend to have more adobe (bits of clay) and stones). It is also helpful to cover the beans with cold water, let sit for 5 minutes and remove anything that floats. Repeat to be sure all dirt and foreign matter is removed. Drain and ready to cook

Here is one great way of eating black beans.

Bean, Barley & Avocado Summer Salad

This can be refrigerated and stored for several days!

1 cup carrot juice
½ teasp. Thyme
½ teasp. Sea salt
1/8 teasp. Ground Cayenne pepper
1.2 cup quick-cooking barley
3 Tablespoons Lime or Lemon Juice
1 Tablespoon Virgin Olive Oil
1 can (9 oz) black beans, rinsed and drained
1 cup diced tomatoes
½ cup diced avocado

Combine carrot juice, thyme, sea salt and cayenne in a saucepan. Bring to boil over medium heat; add barley and reduce to a simmer. Cover with lid and simmer until barley is cooked, approx. 15 minutes.

While beans are simmering whisk lime/lemon juice and oil in a large bowl. Add barley when cooked and any liquid remaining in the barley. Toss to coat all.
Add beans, tomatoes and avocado, toss to mix well. Serve on a lettuce leaf.

Utah Judge Strikes Down Ephedra Ban

SALT LAKE CITY (AP) - A federal judge has struck down the FDA ban on supplements containing ephedra, a weight-loss aid linked to dozens of deaths, but it's too early to tell whether the product will be back in stores anytime soon.

The judge Thursday ruled in favor of a Utah supplement company that challenged the Food and Drug Administration's year-old ban. Nutraceutical claimed that ephedra has been safely consumed for hundreds of years.

Research shows that the amphetamine-like herb can speed heart rate and constrict blood vessels even in seemingly healthy people, but it is particularly risky for those with heart disease or high blood pressure or who engage in strenuous exercise. Among the deaths linked to the substance was that of Baltimore Orioles pitching prospect Steve Bechler, who collapsed and died during spring training two years ago.

The judge's decision was seen by some anti-ephedra advocates as falling short of an outright reversal of the ban, though a Nutraceutical lawyer declared flatly, "the ban is gone." The company said it is too soon to say whether it will put the product back on shelves.

Industry groups said supplements that included ephedra were once used by 12 million people.

Judge Tena Campbell's order prevents the FDA from stopping Nutraceutical from selling its product and sent the case back to the FDA for a determination of what are safe and dangerous levels of ephedrine.

The FDA was evaluating the ruling, but Health and Human Services spokesman William Pierce said the agency "made the right decision from the standpoint of science and our statutory authority. This is exactly when the dietary supplement law should apply."

Health officials and Justice Department lawyers are looking at the ruling to determine the next step, Pierce said.

Campbell agreed with Nutraceutical that ephedra was wrongly being regulated by the FDA as a drug and not a food. She said a 1994 federal dietary supplement law places more restrictive rules on the FDA in determining whether to ban foods as opposed to drugs. The judge said the law requires the FDA to prove that a dietary supplement is harmful, rather than having the manufacturer prove it is safe, as is required with drugs.

"The (FDA's) statement that a safe level cannot be determined is simply not sufficient to meet the government's burden," Campbell wrote.

Nutraceutical President Bruce Hough said the lawsuit had little to do with ephedra and more to do with forcing the FDA to follow the rules Congress set down for it.

"This is a great affirmation for the system, that the court goes back and says, 'This is Congress' intent,' and follow it," he said.

Ephedra opponents said the language in the order applies only to a very specific, lower-dosage segment of the market. The ruling's final page prohibits the FDA from enforcing the ban on Nutraceutical's supplements containing 10 milligrams or less of ephedra.

Ten milligrams per day was the dosage of Nutraceutical's products.

"No one - not the FDA, the supplement industry, nor the public - has been satisfied by how ephedra has been regulated," said Sen. Orrin Hatch, R-Utah, who helped write the 1994 law that also deregulated the supplement industry. "Millions of people have used the product with satisfaction, but there is no doubt the product has had some serious problems," he said.

Illinois Democratic U.S. Sen. Dick Durbin, a frequent ephedra critic who worked for the ban, said the ruling underlined the need for "a mandatory and uniform system of reporting adverse health events that result from use of certain dietary supplements."

Mercury in Fish Prompt Broader N.Y. Ban

ALBANY, N.Y. (AP) - The state Health Department on Friday warned women of childbearing age and children younger than 15 to avoid eating most species of fish caught anywhere in the Adirondacks and Catskills. The advisory is one of the most expansive ever in New York regarding mercury found in fish.

The warning says young women and young children should avoid eating northern pike, pickerel, walleye, largemouth bass, smallmouth bass and larger yellow perch from all waters in the Adirondack and Catskill mountain regions because of mercury contamination.

The advisory comes after years of restricting individual ponds, lakes and other waterways.

"I think it's a reasonable thing for the state to do," said John Sheehan of The Adirondack Council, an environmental group. "We can only test a few each year, but the consistent pattern is we find contaminated fish almost every time we tested. It only makes sense."

In addition, the state Health Department issued 117 more advisories for water bodies statewide that range from eating no more than one meal per month of largemouth bass larger than 15 inches caught in Rockland County's Breakneck Pond to eating no chain pickerel of any size from Sunday Lake in Herkimer County .http://www.health.state.ny.us

In 2004, 50 waterways had health advisories due to elevated mercury levels, 30 of them in the Adirondacks. The Adirondacks now have nearly 40 waters with warnings, Sheehan said.

Mercury can effect a developing nervous system as well as the development of organs in a fetus, infants and young children. Some of the contaminants may also build in women and may be passed on during breast feeding, according to the state Health Department.

A "meal" is defined by the state Health Department as a half-pound of fish.

The state Health Department and Department of Environmental Conservation regularly test the state's waters.

The advisories could hurt the Adirondacks and Catskills, which draw tourists and anglers each year from around the world, said Sheehan.

"It's tragic that we have to do this ... but we may be seeing the worst of it right now," he said.

Federal and state action is limiting smokestack pollution from power plants and other facilities. That not only reduces the amount of mercury residue that falls in New York, but also the compounds that create acid rain in New York. Acid rain accelerates the absorption of mercury in fish, Sheehan said.
