Pharmacists Can Be Liable for Drug Risks

MIAMI (AP) - A pharmacist can be held responsible for failing to warn about a medication's risks, even when filling a doctor's prescription, a Florida appeals court ruled.

The 4th District Court of Appeal said the duty to warn about using drugs repeatedly or in harmful combinations is based in the requirement that pharmacists have "general knowledge" of medicines they dispense and the risks they present.

The ruling this week lets Robert Powers pursue claims of negligence against two pharmacies - Your Druggist and The Medicine Shoppe - that filled his wife Gail's prescriptions for neck and back pain. She died of an overdose in October 2002.

The pharmacies said they plan to appeal.

Powers' attorney Peter Herman said the ruling was important for consumers because "a pharmacist is probably going to be in the best position to raise a red flag" about potentially harmful drugs.

Gail Powers, a 46-year-old waitress, had been taking six drugs, including painkillers OxyContin and Percocet and the anti-anxiety drug diazepam. These drugs can be harmful if taken together and some are highly addictive with long-term use, according to the Food and Drug Administration.

The negligence claims Robert Powers brought against the pharmacies had been dismissed by a trial judge, who said that under Florida law druggists are not liable if they are filling a doctor's legal prescriptions.

Wednesday's appeals court ruling reversed that decision while making no decision on the merits of Powers' claims.

"A strong policy basis already exists supporting a pharmacist's duty to warn customers of the risks inherent in filling repeated and unreasonable prescriptions with potentially fatal consequences," Judge Mark E. Polen wrote for the court.

The Romantic Fruit

This fruit is probably the most used fruit for romantic interludes. Some chocolate covered others simply fresh? Little do they know how healthy strawberries are... This time of year will find this romantic fruit in our home, but not for long. We have a small strawberry patch but gives us a bowl full every week or so and taste so much sweeter than the ones I buy in the store. Of course they have no fertilizers, chemicals or pesticides on them which doesn't detract from the taste or nutrients.

This time of year Strawberries make their way onto may tables in the form of strawberry pie, shortcake and mixed with other fruits as smoothies or pureed and added to fruit punch the rest of the year. Making for a great sweets treat year round when frozen. Our grandkids love the berries frozen whole to eat like candy, which makes for a healthy body and strong teeth as well as regular bowel habits.

Strawberries contain these teeny tiny seeds that make up their mystic and crunchiness. These berries carry a huge portion of antioxidants. The nutrients known to prevent and/or kill cancers of various types. Loaded with minerals and vitamins that is healthy for every body!

Berries of many kinds have been used for centuries as a diarrhea and anemia treatment. Leading me to believe berries and in this instance strawberries are very important in preventing problems.

Horticulturists have always known that a seed holds the embryo of new life. Scientists are confirming that berry seeds contain high levels of life prolonging Essential Fatty Acids or EFA?s, just as effective as other EFA bearing nuts and fish, known to be an effective protection against heart disease, diabetes and cancer.

Alternative Medicine has always said that health starts in the Intestinal system with absorbing while disseminating nutrients through out the body, as well as the intestinal systems ability to move along toxins before they can damage the body, and the faster this happens the better for your health. Speedy removal of toxins and dissemination of nutrients happen when the intestines contain the proper amounts of probiotic bacteria and the proper fiber is introduced, and these tiny little seeds move things along swiftly.

EFA's and Your Health

Essential fatty acids (EFA) found in berry seeds are linoleic, alpha linolenic and oleic acids. EFA's are abundant in the seed oil of berries. Also is a very rich source of alpha and gamma tocopherol as well as y-tocopherol. This tocopherol or Vitamin E rich composition is said to be important in the prevention of degenerative disease such as diabetes. Previous testing established the presence of ellagic acid, a cancer fighting polyphenolic, found and concentrated primarily in the teeny tiny seeds of the berries. Medical research programs studying ellagic acid and demonstrated its ability to inhibit the number and size of chemically induced tumors of the esophagus of rats. (Stoner and Mukhtar, 1995).

Fresh strawberries have a delicious naturally sweet taste but there's only about 50 calories in a whole cup! Strawberries are highly nutritious. Eight medium size fresh berries contains about 150% of the recommended daily intake of vitamin C and 20% of folate. They're also high in potassium and a good source of dietary fiber.

Choose strawberries with a bright red color and fresh green caps. Since strawberries do not continue to ripen after they've been picked, don't buy berries that are partly white and unripe. The size of a strawberry is not a factor in determining the sweetness or taste. That's determined by the variety of strawberry, weather and growing conditions, and the degree of ripeness when picked. Fully ripe berries, large or small will be equally sweet and flavorful.

Do not wash fresh strawberries or remove the caps until you're ready to eat them or use them in a recipe. Store strawberries in a covered container in the refrigerator and use them as soon as possible after you buy them. To wash strawberries, place them in a large strainer or colander and rinse with cool water. Remove their green caps with the point of a paring knife or gently twist and pull them off.

Fresh Strawberry Pie

1 quart strawberries - washed and hulled
1 T. lemon juice
1/2 cup sugar
1 T. cornstarch
1 baked pie shell
whipped cream or whipped topping

Preparation -
Crush 1 cup strawberries in a food processor or blender. Pour the crushed berries in a saucepan. Add the lemon juice, sugar, & cornstarch. Cook over medium heat, stirring constantly, until the mixture is thickened and clear. Remove from heat & chill. Fill pie shell with whole strawberries and when mixture has cooled pour over strawberries or you can add the strawberries to cooled mixture then pour into pre-baked pie shell. Chill for 1 to 2 hours before serving. Top individual servings with whipped cream or whipped topping. Enjoy!

Sadly food alone will not do the trick as it would in centuries past so we can't rely totally on our food intake, because of the lack of nutrients in our soils and the pollutants added in the form of air pollution, pesticides and fertilizers. Read the 1936 Report Click Here

Grandpa's Poisons May Affect You, Rat Tests Show

WASHINGTON - Toxic chemicals that poisoned your grandparents, or even great-grandparents, may also affect your health, US researchers suggested on Thursday.

A study in rats shows the effects of certain toxic chemicals were passed on for four generations of males.
The finding, published in the journal Science, suggests that toxins may play a role in inherited diseases now blamed on genetic mutations.

"It's a new way to think about disease," said Michael Skinner, director of the Center for Reproductive Biology at Washington State University in Pullman.

"We believe this phenomenon will be widespread and be a major factor in understanding how disease develops."

For their study, Skinner and colleagues injected pregnant rats with vinclozolin, a fungicide commonly used in vineyards, and methoxychlor, a pesticide that replaced DDT.

Both are endocrine disrupters -- synthetic chemicals that interfere with the normal functioning of reproductive hormones, notably testosterone and estrogen. Animal studies have shown they can affect fertility and the development of genitals, for example.

Scientists knew that treating pregnant rats with high doses of vinclozolin every day produces sterile male pups.

Skinner's team injected vinclozolin into pregnant rats during a specific time during gestation when the developing embryos take on sexual characteristics. "It is when either an ovary or testes develop," Skinner said in a telephone interview.

The time was comparable to mid-gestation in humans.

Male rat pups born to these mothers had a 20 percent lower than normal sperm count, their sperm were less motile, meaning they did not swim as well, and they were less fertile.

There were similar results with methoxychlor.

When these male offspring were mated with females that had not been exposed to the toxins, 90 percent of the new male offspring had similar problems. The effect held for a fourth generation.

That has never been seen before, although radiation and cancer chemotherapy are known to affect fertility and the children of people affected.

Radiation can also cause "germline" genetic mutations -- mutations in DNA in egg and sperm cells that can be passed from one generation to the next. But it happens only rarely.

"What we appear to have done is re-program that germline and that re-programming is permanent," Skinner said.

These changes were not mutations, Skinner's team said. Instead, they were changes in a process called methylation, in which chemical compounds attach to and affect DNA.

The timing is important, too, Skinner said. When they injected the chemicals into the rat mothers later in gestation, there were no changes in the pups.

Now his team is studying the genes that are affected. Preliminary evidence in the rats suggests that genes known to affect diseases such as breast and prostate cancer may be affected by this process.

They also plan to see if other chemicals can have the same effects.

"It is important that we say these are preliminary studies," Skinner stressed. The levels of chemicals the rats were exposed to were very high -- much higher than people normally ever encounter.

Japan Finds US Biotech Corn, now to Test all Imports

WASHINGTON/CHICAGO - Japan, the biggest buyer of US corn, found an American shipment tainted with the unapproved Bt-10 biotech variety and will begin testing every US cargo, a Japanese official told Reuters on Wednesday.

The official, who is familiar with agricultural trade matters, confirmed that last Thursday a 390-tonne shipment to Japan from the United States was found to contain Bt-10. Bt-10 corn, manufactured by Swiss agrochemicals group Syngenta AG, is engineered to resist the corn borer insect. It was accidentally mixed with US grain shipments between 2001 and 2004.

"Bt-10 is not approved in Japan and we cannot allow this corn to be imported into Japan," the official said.

Last month, the Japanese government began spot-testing some US cargoes for Bt-10 corn. Japan has a zero tolerance policy on imports of unapproved biotech foods.

"Because of this incident, we will test every US vessel importing corn into Japan," the official said. "Before that we were doing some sampling testing. But after this incident we will enhance the tests."

The corn is not approved for use in the United States or Europe, but the US Agriculture Department and the US Environmental Protection Agency have said the variety does not pose a danger to people, animals or plants.

Consumers in Japan, a major buyer of American commodities, have long been skittish about gene-altered food and its possible long-term impact on human health and the environment.

Despite the contamination, the official said Japan would not halt corn imports from the United States. "We will continue to import US corn but we have to test it," he told Reuters.

Japan buys about 16 million tonnes of corn annually, with 90 percent of it from the United States.

Corn futures on the Chicago Board of Trade were unfazed by the news. The July delivery contract rose 2-1/2 cents to end at $2.24-1/2 per bushel due to concerns that dry weather in parts of the Midwest could hurt the newly planted crop.

"For the market to react to this you'll need the Japanese government to come out and put a ban on US corn imports into Japan. But if they do, where else are they going to buy corn from?" said one exporter, who declined to be named.

However, industry experts warned that corn prices might be affected if more contractual requirements were to be placed on shipments to Japan, as the cost of providing those services would have to be accounted for somewhere along the line.

The United States is the world's top corn exporter, with smaller amounts shipped by China, Argentina and South Africa.

A US trade source said Japan would likely ship the tainted supplies back to the United States, with Syngenta picking up the tab.

It may not be possible to pinpoint the exact source of the contaminated corn, experts suggested. Under the US system of collecting it for export, corn is transported from across the country and funneled into vessels waiting to ship it. So the contaminated cargo may be traceable only back to the last vessel loading point.

"Japan is our largest export market. For 2004-2005 it imported 22 percent, or 661 million bushels, of our corn. So obviously we are interested in following this issue," said Rhonda Lee Dean-Royce, spokeswoman for the National Corn Growers Association.

The European Union already blocked imports of corn from the United States unless shipments carry proof they are free of Bt-10 corn.

The Syngenta contamination became public in March and the US Agriculture Department fined the company $375,000.

A spokesman for Syngenta in Zurich said the company knew it was "possible" that some Bt-10 could be found in Japan.

Last month, a US cargo of corn gluten feed was found tainted with Bt-10 corn and was impounded on arrival at an Irish port. An industry source said the cargo shipped to Ireland was one of the few that left US shores for export destinations before a testing program was introduced.
