Suits against drug makers run into federal opposition
Administration opposes damages if product has been approved by FDA

WASHINGTON - The Bush administration has been going to court to block
lawsuits by consumers who say they have been injured by prescription
drugs and medical devices.
The administration contends that consumers cannot recover damages for
such injuries if the products have been approved by the Food and Drug
Administration. In court papers, the Justice Department acknowledges
that this position reflects a "change in governmental policy," and it
has persuaded some judges to accept its arguments, most recently scoring
a victory in the federal appeals court in Philadelphia.
Allowing consumers to sue manufacturers would "undermine public health"
and interfere with federal regulation of drugs and devices, by
encouraging "lay judges and juries to second-guess" experts at the FDA,
the government said in siding with the maker of a heart pump sued by the
widow of a Pennsylvania man.
Moreover, it said, if such lawsuits succeed, some good products may be
removed from the market.
In 2002, at a legal symposium, the Bush administration outlined plans
for "FDA involvement in product liability lawsuits," and it has been
pursuing that strategy.
The administration's participation in the cases is consistent with
President Bush's position on "tort reform."
Bush often attacks trial lawyers, saying their lawsuits impose a huge
burden on the economy and drive up health costs. The Democrats' vice
presidential candidate, Sen. John Edwards, a longtime plaintiffs'
lawyer, says his proudest accomplishment in Washington was to help win
Senate passage of a bill defining patients' rights, including the right
to sue. (The bill never became law.)
Jay Lefkowitz, former director of Bush's Domestic Policy Council, said
the FDA's litigation strategy embodied "good health policy and good tort
reform."
But Rep. Maurice Hinchey, D-N.Y., said the administration had "taken the
FDA in a radical new direction, seeking to protect drug companies
instead of the public." Hinchey recently persuaded the House to cut
$500,000 from the budget of the agency's chief counsel as a penalty for
its aggressive opposition to consumer lawsuits.
In the Pennsylvania ruling, issued Tuesday, the appeals court threw out
a lawsuit filed by Barbara Horn, who said her husband had died because
of defects in the design and manufacture of his heart pump. The Bush
administration argued that federal law barred such claims because the
device had been produced according to federal specifications. In its
briefs, the administration conceded that "the views stated here differ
from the views that the government advanced in 1997," in the U.S.
Supreme Court.
At that time, the government said that FDA approval of a medical device
set the minimum standard, and that states could provide "additional
protection to consumers." Now the Bush administration argues that the
agency's approval of a device "sets a ceiling as well as a floor."
The administration said its position, holding that individual consumers
have no right to sue, actually benefited consumers.
The threat of lawsuits, it said, "can harm the public health" by
encouraging manufacturers to withdraw products from the market or to
issue new warnings that overemphasize the risks and lead to
"underutilization of beneficial treatments."

drawn from making manufacturers withdraw a dangerous product or make
them liable for bad products? Seems to me like that is helping to save
the public... Where are our leaders heads? Not looking out for us that's

companies to do whatever they wish and can kill or maim people without
accountability. The FDA continues to be paid by drug companies to allow
their product on the market so they too should be held accountable as

The Mayo Clinic Health Letter9/24/98 stated; "Once

Drug Maker Acknowledges Misleading Claims

TRENTON, N.J. (AP) - The maker of a popular medicine for schizophrenia
has notified doctors that it minimized potentially fatal safety risks
and made misleading claims about the drug in promotional materials.
Janssen Pharmaceutic Products sent a two-page letter to the health care
community this past week to clarify the risks of Risperdal, Carol
Goodrich, a spokeswoman for the Johnson & Johnson subsidiary, said
Saturday.
The letter stems from a directive issued last year by the Food and Drug
Administration, which told several makers of anti-psychotic drugs to
update their product labels.
Janssen complied in November 2003, but the FDA determined that the
company's promotional materials still minimized the risk of strokes,
diabetes and other potentially fatal complications. The agency also said
Janssen made misleading claims that the medication was safer in treating
mental illness than similar drugs.
The Miami Herald reported Saturday that a handful of boys in Florida
developed lactating breasts after taking Risperdal.
The drug, which is prescribed to more than 10 million people worldwide,
was cited in a federal lawsuit filed earlier this month by a doctor who
claims children have been harmed and even killed by the misuse of drugs
he blames on aggressive marketing by drug manufacturers.
"The FDA did not think we had (initially) provided enough information,
so that is why further notification was done," Goodrich said.
Risperdal is the leading drug used to combat schizophrenia and other
types of psychotic disorders, earning Janssen about $2.1 billion in
annual sales. The drug was first marketed about eight years ago.

The Root So Many Hate!
My husband brought in these beautiful roots from the garden last week,
which we love fresh sliced and eaten raw or the greens cooked with a
dash of rice vinegar added and the root sliced and cooked crunchy
tender. This particular root is not a very popular root and most kids
will turn up their noses at them just from the smell but are packed with
nutrients. That root being Turnips!
Although turnips are usually a spring or fall crop we seem to continue
to have a large number growing in our garden that are just as tasty as
ever.
Turnips and rutabagas are among the most commonly grown and widely
adapted root crops. They are members of the Cruciferae or mustard family
and belong to the genus Brassica. Turnips are (Brassica rapa) and
rutabagas are (Brassica napobrassica). The two are similar in plant size
and general confused as to which is which. You can tell the differences
as turnip roots generally have little or no neck and a distinct taproot,
while rutabaga roots are often more elongated and have a thick, leafy
neck and roots originating from the underside of the edible root as well
as from the taproot.
Good-quality turnips will be very firm, smooth-skinned and heavy for
their size. The coloring will be light-purple on the top fading to
bright-white at the bottom. Avoid turnips that are soft, spongy,
blemished with brown spots, cut or lightweight for its size.
The healthy nutrients gained when eating turnips;
Heavy in fiber content, which is needed to keep the intestinal tract
working properly and healthy flora thriving. Good healthy nutrients
include the minerals; Calcium, Iron, Magnesium, phosphorus, Potassium,
Sodium, Zinc, Copper, Manganese and Selenium. Vitamins are; Vitamin C,
Riboflavin, Niacin, Pantothenic acid, B-6, Folate, Folic acid, B-12,
Vitamin A, Retinol and Vitamin E.
Turnip green tops are loaded with nutrients but not usually taken from
full grown roots as they will be tough and require a much longer cooking
time and a lot of flavoring to mask the bitter taste. Greens are usually
picked for eating before the roots develop into full grown bulbs. Turnip
greens are really too tough and strong to eat raw and will need to be
cooked.
Fooling Turnip Haters Recipe
2 pounds fresh turnip roots
1 fresh apple (optional)
2 or 3 tablespoons margarine
1 tablespoon sugar
Salt and pepper to taste
First peel the turnips with a vegetable peeler. Peel the apple too if
you like, but it isn't necessary, unless he skin is really ugly. Chop
or slice the turnips, (and the apple) into the chunks the right size for
eating. Fill a big pot half full of water. Add the turnips, apple (if
you're using it), the margarine, sugar and salt and pepper as you like.
Cover the pot and simmer on the back of the stove for about 20 minutes,
or until the turnip chunks are tender to your preference. Serve hot.
They will never know they are eating turnips.
Root vegetables are usually very nutritious and health builders, so go
out and eat them knowing you are getting healthier for it.

Is Angioplasty Right for All Heart Patients?
Experts differ over procedure's merits in many cases

FRIDAY, July 23 (HealthDay News) -- Heart specialists perform an
estimated 1.2 million angioplasty procedures each year,
according to the Society for Cardiovascular Angiography and
Interventions.
But are they all necessary?
That depends on whom you ask, and what studies you cite.
Conventional cardiology wisdom has long held that heart attacks
occur because arteries blocked by the buildup of plaque starve
the organ of blood, sending it into a condition called
infarction. Under that model, angioplasty, stenting (placing of
a wire mesh structure in the blood vessel) and bypass surgery
all make a certain amount of sense.
Angioplasty lets doctors thread a snake-like device with a
balloon on the end into diseased and narrowed arteries.
Inflating the balloon opens the blockage. Usually, cardiologists
will leave behind one or more tiny metal scaffolds, called
stents, as insurance.
Many cardiologists have long held that heart attacks result not
solely from severe narrowing but also from so-called
"vulnerable" plaques that shear off vessel walls, leading to
clotting and infarction. That view has been gaining increasing
credence lately, even among more aggressive heart doctors --
with major implications for invasive procedures to widen
vessels.
While it's true that a very tight blockage causing chest pain --
or angina -- may spark a heart attack, most attacks occur at
narrow spots in the blood vessel that are less serious but are
considered to be vulnerable to plaque rupture.
As a result, experts say, many people who undergo angioplasty
and stenting would likely do fine with a so-called "vasculo-protective
cocktail" of medications that address vessel disease and its
complications: statins for cholesterol, aspirin to prevent
clotting, ACE inhibitors to improve heart function, beta
blockers for blood pressure, relaxing vessels and correcting
abnormal heart rhythms.
But changing practice patterns might take some time, said Dr.
Jonathan Abrams, a cardiologist at the University of New Mexico
School of Medicine.
"It's too big a boat to turn, it hasn't turned yet," Abrams
said. "There clearly are people who need angioplasty. The issue
is how to use these therapies and who to use them in."
Dr. Thomas Graboys, of the Lown Cardiovascular Center and
Harvard Medical School, provides second opinions to patients
who've been told they need angioplasty.
Although exact numbers are elusive, Graboys estimates that half
of Americans who receive stents each year could do just as well
on medical therapy.
"We're not against stents, they can be potentially lifesaving,"
Graboys said. "But that's not the population that's receiving
them. Medical therapy is very good, it's outstanding now," he
added. "Compared to 10 years ago, we've turned the corner in
management" of coronary artery disease.
The most important question cardiologists should ask, Graboys
said, is not how narrow their patients' arteries are but how
well their heart works. "If it's strong, they do well despite
vessel blockage. But that's not what's happening in this
country."
To be sure, Graboys said, many patients are good candidates for
angioplasty and stenting -- just not as many as undergo the
procedures. If a person has persistent chest pain -- called
unstable angina -- that doesn't improve with medication, then
he'd advise more aggressive treatment.
In addition to being unnecessary in many cases, stenting isn't
risk-free. Around 1 percent of patients suffer a blood clot
linked to the stent procedure itself. Of those, 10 percent to 20
percent prove fatal. That means one to two of every 1,000 stent
recipients dies as a direct result of the device. If Graboys and
like-minded doctors are correct, that works out to between 600
and 1,200 unnecessary deaths each year.
Nor is stenting always successful in the vast majority of
patients who survive the procedure. Blood vessels close up
around the devices, a phenomenon called restenosis, in about 20
percent of patients.
So why is angioplasty overused? The answer is largely economic,
Graboys said. Angioplasty costs roughly $15,000. Conventional
stents run around $2,000 each, but new, drug-releasing stents
that promise less restenosis cost about twice that much. "The
market forces are incredible," he said, with "a host of
non-clinical factors" driving the use of the technology.
Cardiologists, Abrams agreed, are generally overeager when it
comes to angioplasty. "We're doing too much ballooning, and now
that we have stents it's even worse," he said.
Abrams is an advocate of much wider use of the vasculo-protective
drug regimen.
"That cocktail clearly reduces risk and may in fact stop
atherosclerosis in its tracks," he said.
Doctors need to work toward ensuring that every patient
discharged from the hospital with coronary artery disease leaves
with a prescription for the treatment -- regardless of whether
or not they've had angioplasty, Abrams said. "This is the place
to put our money, and we are not doing an adequate job," he
said.

LENA'S NOTE: Too bad they won't accept the fact that 99%
of heart surgeries can be avoided with chelation IV therapy.
This I know first hand as I was diagnosed with a 75% to 80%
heart blockage and the cardiologists wanted to do surgery but I
walked out of Loma Linda University Hospital Cardiology floor
AMA and went to see Dr. Julian Whitaker in his Newport Beach

in 1991 have had no after affects, memory intact and no chemical
medications to continue the blocking process. No chest pains,
shortness of breath or blacking out as before the treatments.

Ill. Experts Fault Insecticide Practices

URBANA, Ill. (AP) - Two University of Illinois experts have sharply
scolded insecticide salesmen for persuading some farmers to disregard
time-tested, environmentally sound pest management principles for
promises of big harvests.
The two entomologists, writing in the July 23 issue of the
university-published Pest Management and Crop Development Bulletin,
criticized chemical companies for recommending that farmers spray for
insects even if they aren't threatening the economic viability of the
crop.
"Recommending insecticides to prevent insect infestations is foolish and
irresponsible," Kevin Steffey and Michael E. Gray wrote, adding that
such recommendations violate the principles of integrated pest
management. Those accepted practices are defined as combining
biological, cultural, physical and chemical tools in a way that
minimizes economic, health and environmental risks.
Integrated pest management principles call for farmers to know that they
have an insect infestation sufficient to affect their yield before
calling in crop dusters or spray wagons. Doing otherwise could mean
needless environmental impact and wasted money, the experts said.
"It's the culmination of a lot of what I consider to be fairly
widespread misuse of IPM principles over the past five years or so,"
Steffey said of the criticism. Marketing promotions this summer
recommending inclusion of an insecticide with Roundup when the weed
killer was applied to soybeans in June were "just sort of the final
blow."
"This nonsense with applying insecticides with Roundup for soybean
fields is just blatant disregard. Farmers spent money they didn't need
to spend," Steffey said.
Steffey and Gray were especially critical of Sygenta Crop Protection
Inc., which mailed some customers a flier that promised potentially
bigger soybean yields if two of its products - a fungicide and an
insecticide - were applied together.
The entomologists did not address the fungicide, but said
"recommendation of the inclusion of an insecticide, regardless of the
product and without justification for insect control when densities
reach or exceed published economic thresholds, is irresponsible.
"We are beginning to wonder whether the principles of IPM are being
considered at all when such recommendations are made," the scientists
wrote.
Sygenta, a Switzerland-based company whose U.S. operations are based in
Greensboro, N.C., defended the promotion.
"Growers who didn't spray last year suffered significant damage" from
soybean aphids, said spokesman Mike Vanausdeln. Even though aphids have
not been a major problem in Illinois this year "we felt it was better to
err on the side of caution."
The University of Illinois Agronomy Handbook, which is endorsed by the
industry-representing Illinois Fertilizer and Chemical Association, says
deciding whether to use insecticides "should be based upon information
gathered from regular and thorough scouting procedures." The number of
insects in a field should be compared to established thresholds for
economic damage before deciding whether to spray, Gray said.
But Vanausdeln said those thresholds are hard to determine, especially
when a farmer is dealing with more than one pest. He said farmers are
encouraged to check with their sales representatives before ordering
chemicals.
"It's not something we would just recommend to everybody," Vanausdeln
said.
But Gray said he fears drive for profit has eclipsed smart agriculture.
"I think sometimes industry will create attractive marketing, I guess I
would call it marketing ploys really, to sell products," he said.
