U.S. House Rewards Pharmaceutical and Medical
Negligence; Punishes Victims

"The House vote today (230-194) to shield the medical industry from
accountability for negligence is an abhorrent abuse of federal power
that shifts costs from wealthy corporate interests to patients who are
severely injured by defective drugs, medical devices or poor medical
care."
Physicians who are supporting this legislation, H.R. 5, are being
scammed, because it would do nothing to bring down their high medical
malpractice insurance rates. Study after study has shown that the
driving forces behind rising malpractice premiums are the economic cycle
and the business decisions made by insurers. The so-called ?crisis? of
patients lawsuits is pure fiction. In fact, both the number and the
total value of malpractice payouts to patients has remained flat since
1991 and has significantly declined since 2001, when adjusted for
medical inflation.
Rather than punishing innocent victims by arbitrarily capping
malpractice payments, Congress should seek to reduce medical mistakes
and scrutinize the practices of malpractice insurers, who are taking
advantage of captive clients, weak competition and lax regulation to
more than make up for disappointing investment returns. From 2000 to
2004, the top 15 malpractice insurers, on average, raised their rates by
120 percent while payouts increased only 5 percent.
But while malpractice rates have begun to stabilize due to the improved
economic climate, the Republican-led House has voted to slash the legal
rights of people whose lives are devastated by medical negligence. This
legislation would usurp the role of state juries and judges by slapping
an arbitrary, maximum price tag of $250,000 on the pain and suffering of
severely injured victims, even when they are blinded, paralyzed,
disfigured, irreversibly brain-damaged or left to cope with the death of
a child or spouse. Because only the most seriously injured patients ever
collect pain and suffering awards greater than $250,000, the damage caps
harm them the most. It also would exempt pharmaceutical companies from
the threat of punitive damages as long as their products meet FDA
compliance ? which all of the products they sell do ? despite
revelations that the FDA has been ineffective in overseeing drug safety.
It also would lift the threat of punitive damages from nursing home
corporations whose reckless hiring practices render ailing, elderly
residents more vulnerable to abuse.
But the bill will do nothing to address the fact that as many as 100,000
people a year die from preventable medical errors in hospitals alone ?
or the fact that just 5.5 percent of doctors now account for 57 percent
of malpractice payouts. It will only increase hardship for innocent
people seeking justice once the damage is done. The Senate should reject
this blatantly anti-patient bill.

European Food Supplement Ban Avoided

Legal challenge and cooperation between industry and government avert
wide-scale food supplement ban previously anticipated today.
FOOD SUPPLEMENT BAN AVOIDED BY MUTUAL COOPERATION
Today could have seen up to 5,000 vitamin and mineral products being
banned from health store shelves in the UK alone, with further products
being banned in other EU countries such as Ireland and Sweden.
But, following the legal challenge to this ban implicit in the EU Food
Supplements Directive, mounted in 2003 by the Alliance for Natural
Health and two UK trade associations, the National Association of Health
Stores and the Health Food Manufacturers Association, mutual cooperation
between the health industry and government authorities has seen the
wide-scale ban circumvented.
The ban would have affected products containing over 200 vitamin and
mineral ingredients which had not been subject to extensive safety
evaluation by the European Food Safety Authority, but nevertheless had
been consumed safely as part of the normal diet for thousands of years.
Dr Robert Verkerk, executive director of the pan-European Alliance for
Natural Health said: ?Without positive pressure from our legal
challenge, and increasing amounts of cooperation between industry and
government authorities, thousands of products containing nutrients which
are increasingly difficult to find in our normal diet, but known to be
of great importance to our health and wellbeing, could have today been
removed from our food supply. We are working hard to bed in our
barristers' positive interpretation of the European Court ruling.
However, we cannot afford to sit back as future provisions in the
Directive set to limit maximum potencies of food supplements could have
devastating consequences at least equal to those caused by the
originally proposed food supplement ingredients ban."
The European Court of Justice handed down its ruling on the legal
challenge to the Food Supplements Directive on 12 July. Although the
Directive was upheld, the ruling reduced its scope and greatly improved
its clarity, so reducing obstacles to the health food industry. In
particular the ruling will make it much easier to access the "positive
list" of allowed ingredients, a process previously described by a senior
advisor to the Court, Advocate General Leendert Geelhoed in his 5 April
Opinion, as "clear as a black box".
The Directive provided a derogation system which would allow ingredients
present on the market prior to 2003 to be used at least to the end of
2009, on the condition that technical dossiers were submitted to
governmental authorities, for subsequent consideration by the European
Food Safety Authority. The dossier requirements were seen as excessive
and pressure from the industry, facilitated by the legal challenge, led
the government to agree simplified dossier criteria.
Accordingly, some 505 dossiers for vitamin and mineral ingredients were
submitted by 12 July, the official deadline for derogation dossier
submissions. To facilitate the process further, the UK's Food Standard
Agency has also extended the dossier deadline until today. All products
containing ingredients subject to dossiers will remain on the market to
at least the end of 2009 unless they are given an unfavourable review,
on the grounds of risks to public health, by the European Food Safety
Authority.
In the meantime, onus is on the health food industry to make submissions
to the previously limited "positive list", which currently contains just
112 vitamin and mineral forms, as compared with over 300 used by the
industry. As a result of the European Court ruling, exemption for
certain natural forms of vitamins and minerals, clarified and simplified
requirements for access to the "positive list", and placement of the
primary burden of proof of safety on government authorities rather than
industry, the Alliance for Natural Health is confident that the
"positive list" will no longer act as a major barrier to getting
products on to the EU's "positive list" of ingredients allowed in food
supplements.
Provisions in the EU Food Supplements Directive which aim to set maximum
dosages for vitamin and mineral products are in the process of being
finalised by the European Commission and the Codex Alimentarius
Commission, which is developing international guidelines for food
supplement potencies modelled very closely on the EU Directive. The
Alliance for Natural Health has argued, with the support of scientists
around the world, that the scientific method being considered to set
maximum potencies is flawed.
"We must now move from a legal battle to a scientific battle", adds
Verkerk, "the risk assessment framework that is being considered by the
authorities has been borrowed from those systems assessing intrinsically
toxic substances such as drugs and pesticides, and have no place for use
with nutrients that are essential to life. A new paradigm for
safety/benefit analysis is needed specifically for nutrients, and we
have commissioned the Netherlands-based HAN Foundation to come up with a
new framework that could be used EU-wide and internationally through
Codex."

Figgy Food Medicine
Being in Southern California this week among the vegetables in my
sister-in-laws back yard, along with citrus and a Fig tree that was
loaded and my dear husband eating his fill right off the tree I thought
this weeks food should be on his love. FIGS!
Now I'm not a great fan of figs but I will eat them occasionally.
Have you heard of a Fresh Fig Poultice? No! Its use is found in the
Bible in Isaiah 38:21 Works, wonders for boils and skin infections.
Figs are one of the first known natural medicines. The Roman writer
Pliny, (52-113 AD) said, "Figs are restorative. They increase the
strength of young people, preserve the elderly in better health and make
them look younger with fewer wrinkles."
Figs contain the photochemical psoralenes, which helps bring about
beneficial results in skin injuries, hence a fig poultice to draw and
infection to a head. Also beneficial in the removal of dead skin tissues
as for cosmetic use in facial scrubs, and in a skin disease involving
lack of pigmentation in patches of skin (vitiligo). I bet it is the
mineral properties contained in figs that does the trick!
Both fresh and dried figs are great medicinals!
Dried, having about 5 times the amount of nutrients as fresh.
Figs have the highest overall mineral content of all common fruits.
A 40 gram (1/4 cup) serving provides 244 mg of potassium (7% of the DV),
53 mg of calcium (6% of the DV) and 1.2 mg of iron (6% of the DV). On
top of that contain the calming vitamins B1 and B2.
Great for intestinal balance and cleansing Figs have the highest
dietary fiber of any common fruit, nut or vegetable. They are high in
peptic fiber, which is a soft soluble fiber and helps the body remove
toxic wastes and reduces cholesterol levels. They are good to prevent
and relieve constipation. Chinese medicine recognizes figs as a toxin
neutralizer. One of the most alkalizing foods, figs can help balance the
acid that forms from diets rich in meat and refined foods. Figs contain
significant amounts of the proteolytic enzyme Ficin which is a digestion
enzyme helping with the digestion especially of proteins.
Word of caution;
check that the figs you are buying are organic and of good quality.
Fumigation is sometimes used to assure the absence of insects in figs
and sulphur dioxide is used to maintain their sweet flavor and rich
color. Dried figs infested by mites (rare but possible) may cause severe
gastrointestinal conditions if eaten. Mold attack may cause figs to form
mycotoxins, which can make you ill, so stick with fresh when you can.
Need ideas on how and/or when to eat figs?
1. Tuck a few figs into a plastic bag for the office, school, game or
park, makes for a quick healthful snack. Satisfies to a sweet tooth.
2. Keep a container of dried organic figs in a desk drawer at work, to
satisfy late afternoon munchies, or to nibble at coffee break time.
3. Chop a few California figs to add to tossed green salads. They add
delightful sweetness and texture, as well as fiber.
4. Sweeten up mashed or cubed winter squash or sweet potatoes with some
chopped figs adding a richness of their own, so you can skip the butter
or margarine.
5. Blend low-fat cream, ricotta or cottage cheese with some figs to
create a great spread for toast or bagels, or as a dip for sliced fresh
fruit.
6. Chop some California figs to scatter over instant or regular oatmeal
or any cold cereal, skipping the sugar.
Grab a bag from your neighbor's tree and put them into your
dehydrator for future use!

Vom Saal says his research shows a chemical in the lining of cans
leaches into food in amount capable of disrupting hormones in humans.
Samuel Epstein, M.D., an internationally recognized authority on
environmental pollution and cancer, said, "In spite of decades of
research and millions of dollars spent, the cancer establishment remains
myopically fixed on obsolete "blame-the-victim" theories of cancer
causation, while ignoring evidence of the role of environmental
contaminants."
In 1962 and a frontrunner of these problems, Rachel Carson, author of
Silent Spring wrote What is the cause of this cancer
epidemic? Scientific evidence suggests that cancer is in large part
an environmental disease." And that has continued to be found true!
As far back as 1964 the World Health Organization stated that 80 percent
of cancers were due to synthetic carcinogens. But the powerful ?Cancer
establishment?, the American Cancer Society, The National Cancer
Institute, and a number of research and care institutions, all funded
and influenced in part by the chemical and pharmaceutical
industries...would have us believe that the cause is primarily
personal.
"Skin absorption of contaminants have been underestimated and ingestion
may not constitute the sole or even primary route of exposure." States
the American Journal of Public Health, Dr. Halina Brown. It doesn't
take an explosion to understand the problems, once you have the
information! Right!!
Americans used to be the tallest people on the planet, but now we've
slipped to fourth place, according to University of Michigan
anthropologist Barry Bogin. Writing in Discover (Feb. 1998). Bogin
notes that Holland's adult males, once the shrimps of Europe (Averaging
5 feet, 4 inches tall in 1850), are now looking down on everyone else
from an average height of 5 feet, 10 inches, while the Swedish and
Danish are next tallest at 5 feet, 9 inches. The average American man
is taller than his counterpart was 150 years ago-5 feet, 8 inches now
compared with 5 feet, 6 inches in 1850-but poor health and
undernourishment of American children has literally stunted our growth
in this nation! Could it just be our pesticides, chlorine and hormones
found in just about every water system in the U.S.? I think so! The
Netherlands has a clean air policy that is above all other nations,
which is proving to make for healthier people?
Remember what you put in your sink, bathtub, dishwasher, washing
machine, eat or put on your body all goes into the water system at some
point in time and the city systems are not built to remove them and
septic tank systems put them into our ground water.
Ways of changing that are:
1. Purchase only recycled and recyclable products.
2. Use only all natural products; cleaning, skin care, hair care,
dishwashing, laundry, and even when washing your car.
3. Make sure everything possible is biodegradable or recyclable.
4. Buy hormone free, pesticide free foods. Fresh, canned or frozen.
5. Drink, bath and cook with filtered, purified water.

Survey Finds Gulf 'Dead Zone' Much Larger

NEW ORLEANS (AP) - The dead zone off the coasts of Louisiana and Texas
is nearly the size of Connecticut and much larger than federal
researchers had predicted earlier this year, according to a new survey.
An annual weeklong cruise led by researchers with the Louisiana
Universities Marine Consortium found an area of low-oxygen measuring
4,564 square miles and extending from the Mississippi River to the Texas
border. On average, the dead zone has measured about 4,800 square miles
since 1985.
The dead zone, also known as hypoxia, forms each spring and summer as
fresh water enters the Gulf of Mexico and causes large algae blooms. The
algae die and sink to the bottom of the Gulf, where they decompose,
using up oxygen in the deeper, saltier water. Fish avoid the low-oxygen
water, and bottom-living organisms are killed.
The dead zone could in the long-term affect the overall health of the
Gulf's marine species, said Nancy Rabalais, a leading hypoxia researcher
with the Louisiana Universities Marine Consortium. She said researchers
are studying how the dead zone affects the growth and reproduction of
marine species.
The dead zone could grow much larger this year - perhaps as large as
6,200 square miles - if major storms do not stir up the Gulf in the
coming months, Rabalais said.
Officials are looking for ways to cut down on the amount of fertilizer
and pollution in watersheds that flow into the Mississippi and end up in
the Gulf.
The zone's size varies year to year. At 5,800 square miles, last year's
was bigger than Connecticut. The record of 8,500 - about the size of
Israel and a bit smaller than New Jersey - was in 2002.
Earlier this month, the National Oceanic and Atmospheric Administration
had predicted a much smaller dead zone because the Mississippi and
Atchafalaya rivers were carrying much less nitrogen and other nutrients
than usual. NOAA predicted that about 1,500 square miles of Gulf
waterbottom would likely be without oxygen this year.
